Agreement to Terms

By accessing or using Talk with Ren ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Talk with Ren is an AI-powered language learning platform that provides:

• Conversational practice with AI assistance (powered by Google's Gemini models)
• Automatic vocabulary extraction and management
• Spaced repetition review system for vocabulary retention
• Learning analytics and progress tracking
• Session-based learning with topics and difficulty levels

The Service is provided "as-is" during the beta period, and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

2. User Accounts

2.1 Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 16 years old to use the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

2.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to:

• Providing false or misleading information
• Violating our Acceptable Use Policy (see Section 3)
• Attempting to abuse, exploit, or harm the Service
• Sharing or selling your account credentials

3. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including but not limited to copyright laws)
• Transmit any content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to generate, distribute, or store illegal content
• Abuse the AI conversation feature for spam, harassment, or malicious purposes

4. Intellectual Property Rights

4.1 Our Rights

The Service, including all software, text, images, graphics, and other content (excluding User Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

4.2 Your Content

You retain ownership of all messages, notes, and content you create through the Service ("User Content"). By using the Service, you grant us a limited license to:

• Store and process your User Content to provide the Service
• Use aggregated, anonymized data derived from User Content to improve the Service
• Share your User Content with third-party processors (e.g., Google Gemini API) as necessary to provide AI features

5. Third-Party Services

The Service uses Google's Gemini API (specifically Gemini Flash) to power AI conversations. Your use of the Service is also subject to Google's terms and policies:

We are not responsible for the practices or content of third-party services. Your interactions with third-party services are governed by their respective terms and policies.

6. Beta Disclaimer and Warranty

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• Features may change, be removed, or malfunction during beta testing
• Data loss may occur - we recommend not relying on the Service as your only storage method
• Service availability is not guaranteed during the beta period
• AI-generated content may contain errors, inaccuracies, or inappropriate material

7. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, revenue, data, or business opportunities
• Our total liability shall not exceed the amount you paid us in the last 12 months (if any)
• We are not responsible for content generated by the AI, including any errors or inappropriate responses

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Talk with Ren, its affiliates, and its respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and share your data.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

You may terminate your account at any time through the profile settings. Upon termination:

• Your access to the Service will be immediately revoked
• Your data will be handled according to our Privacy Policy
• Sections of these Terms that should survive termination (liability, indemnification, etc.) will continue to apply

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
